1. Introduction

Welcome to FormGPT (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

2.1 Sign-in

You sign in with Google. You must provide accurate information associated with your Google account and comply with Google’s terms when using sign-in.

2.2 Account security

You are responsible for activity under your account and for keeping your Google account secure. Notify us promptly if you suspect unauthorized use of your FormGPT account.

2.3 One person, one account

Do not create multiple accounts to evade limits, abuse the Service, or misrepresent your identity.

3. The Service

FormGPT helps you generate structured form and quiz content with AI, preview and edit drafts in our studio, and optionally export to Google Forms or append questions to forms you can edit in Google. Features, limits, and availability may change over time.

No professional advice. Generated content is for your review. We do not guarantee accuracy, fairness, accessibility, or suitability for exams, employment, legal, medical, or other high-stakes uses. You are responsible for reviewing and approving content before use.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable school, workplace, or platform rules.
• Upload or generate content that is illegal, infringing, harassing, hateful, or otherwise harmful.
• Attempt to gain unauthorized access to our systems, other users’ accounts, or third-party services we integrate with.
• Interfere with or disrupt the Service (including excessive automated requests or circumvention of rate or plan limits).
• Reverse engineer or scrape the Service except where permitted by law.
• Submit highly sensitive personal data (such as health records or government IDs) unless you have a lawful basis and accept the risks described in our Privacy Policy.

5. Your content and drafts

5.1 Ownership

You retain ownership of prompts, uploads, and form drafts you create, subject to third-party rights in source materials. You grant us a limited license to host, process, display, and transmit your content solely to operate and improve the Service (including AI generation and export you request).

5.2 Your responsibility

You represent that you have the rights needed to use and upload materials you provide, and that exported or published forms comply with laws and policies that apply to you (including student privacy rules such as FERPA or COPPA where relevant).

6. AI generation

AI output may be incorrect, incomplete, or biased. You must review drafts before export or sharing. We use third-party AI providers; their availability and behavior are outside our control. We may apply usage limits on free and paid plans to protect service quality.

7. Google Forms integration

7.1 Your use of Google

When you connect and export or append, you authorize us to call Google APIs on your behalf. You are responsible for your Google Forms and Drive use, including sharing settings, respondent data, and compliance with Google’s terms and policies.

7.2 Export and append

We create or update forms only when you take explicit action in the product (for example confirming export or running append). Forms already in your Google account remain under your control in Google if you disconnect or stop using FormGPT.

7.3 No guarantee

We do not guarantee that every question type or setting will map perfectly to Google Forms, that Google’s APIs will always be available, or that exported forms are error-free. Review forms in Google before high-stakes use.

8. Subscriptions and billing

Paid plans (if offered) are billed through our payment provider (for example Stripe) under the prices and intervals shown at checkout. Subscriptions renew until canceled according to the flow we provide. Refunds are described in our Refund policy.

Free-tier limits (such as daily export or append caps) may change; we will reflect current limits on our pricing or in-product messaging where practical.

9. Intellectual property

The Service, including the FormGPT name, branding, software, and design, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you rights to our trademarks except as needed to use the Service as intended.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, pose a security risk, or if we discontinue the Service. Provisions that by nature should survive (including limitations of liability and indemnity) will survive termination.

14. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may be communicated through the Service or by email where appropriate. Continued use after changes take effect constitutes acceptance.

15. General

These Terms are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.

Governing law and venue will be stated here when we designate a primary operating jurisdiction; until then, contact us with questions and we will work in good faith to resolve disputes.
